States Veterans Fireman's League Muster parade on Saturday, August 5, in North Andover. TheBoardwillmake every effort to attend. JURY LIST: The Jury~list for the period July, 1972 to July, 1973 submitted by the Selectman's Secretary was approved by the Board. CERT~ICATE OF INCORPORATION: A certificate of incorporation for Cita Center, Inc. was referred to Chief Lawlor for character references. BUILDING INSF£CTOR REPORT: The quarterly report from the Building Inspector, Charles H. Foster, Jr. was received and approved by the B card. STREE~ LIGHT SURVEY: The Board voted to have a street light survey made for a larger, lumen light on pole 83/11, vicinity of 13 Maple Ave, residence of Francis Murphy. BOUNDARY LINES: LAWRENCE-NORTHANDOVER: An Act changing and establishing.the boundary line between the:City of LawrenceandNorth ' Andover, signed by the Governor, was received by the Board. Chairman Kirk stated thatall that remained to be donewas the placing of the act,~,~ bounds. FIATLEY CONSTB~CTION DRAINAGE: The Board received copy of letter to Jacob Borkover from Charles J. Kane, C.E. of the Flatley Construction Co. requesting permit to install a temporary drain on Rt. 125 to relieve the ponding on Andover St. The Board requested a copy of said letter sent to the Georges family, complainants in the matter. INSURANCE PACKAGE: R. C. Lafond confirmed, by letter, the new insurance policy package outlined in last week's~ minutes. The Board voted to send copies ofsaid letter to Mr. Garofoli and Mrs. Cahill. A letter of appreciation and thanks will be sent to Mr. Lafond for all the time and persistant effort which resulted in such a satisfactory insurance package for the towaat less cost and lower~deductibleamount. PERSONNEL BOAR D: A letter from Chairman John Coady advised the Board of dateof meetings, that their minutes were always available to the public and that a11matters weredecmdedbymajority' vote. ROUTE COMPLAINT: Che~rman Kirk stated that he had received a verbal complaint re the changing of the Trombly Bus town routes from Railroad Ave. and High Street to Furber Ave. The Selectmen had given Trombly permission to change this route to accomodate the elderly housing settlement. The Board voted to have Administrative-Assistant, Jack Erle, look into the matter and submit a report. COMMUNITY COORDINATOR: Due to a prior discussion between Selectman Guthrie, Jack Erle and Bob Naker, Cor~mnity Co- ordinator, a program for, the coming year will. be submitted by Mr. Naker prior to theSelectmem's September meeting. LICENSING COMNISSIONERS: Selectman Joseph A. Guthrie presided as acting-Chairman in the absence of Selectman Duffy who is on vacation. APPROVED: Renewal application for an Auctioneer's license, town-wide, for George H. Kittrell, 534 Chickering Rd. HEARING: DIFLORIO CLASS II LICENSE APPLICATION~ A hearing was held on the Class II license application of Archie DeFlorio, 52 Union St. on located at 17 Massachusetts Ave, a Shell station. 'eh residents attended the meeting and presented a formal complaint andpetitionto limit operating hours of the Shell Station on 17 Massachusetts Ave. from the present 22 hours a da~ to more reasonable time periods in line with the working and sleeping hours of the surrounding community. The following reasons were given: 1. The indiscriminate use of power and hand tools for repairing of cars during the late night and early morning hours. 2. The lack of control and supervision over customers during the aforementioned hours result- ing in a complete break-down of noise control. 3. The general lack of interest in maintaining the peace and quiet of the surrounding community. was signed by 51 residents of Mass. Ave. and Commonwealth Ave. They also stated present owner was selling used trucks andcarswithout a Class II license. Karen: Would you please type up two blank license application forms, as attached, on one piece of paper and make some copies. I don't know where they all went to. Also, if you have time, try to find out in the minutes in the year 1972, any information re: the changing of the boundary line between the City of Lawrence and North Andover. ~? Thank you. m JULY lU, lY,~: (Con~.nuec) ~.x~T Hearing (continued) James McMurray, spokesman for the petitioners, stated that they were opposed to the granting of the Class II license to Archie DiFlorio for the following reasons: Petitioners feel that there are enough businesses in the area now. Noise factor has to be contended with 24 hours a day. Maintenance of cars and trucks goes on day and night, and on Sundays, distubing residents on bothm Mass. Ave. and Commonwealth Ave. Bell at station rings 2~ hours a day. After 12 midnight, young adults and teenagers are present at station ~.th nc supervision or control...brakes screech, cars racing at Barons, coming out on Mass. Ave. causing many near accidents. O~ner of sta'~ion does not cooperate. There are also 30 children in the area that should be considered. Selectman Guthrie stated that conditions that existed now would not be any different if 4 or 5 cazs were parked at the station. The abutters stated that they were opposed to any kind of new business being added;, that it would Just get nois~er and noisier. They further stated that they have been in a bottleneck for so long, they were not going to put up ~ith it any longer. Selectman Kirk stated that this~hearing related to DeFlorio's application for a Class II license...that if the granting of this license is going to accent existing conditions then that should be their objections. The other complaints concerning the garage was.another matter and would be accepted and treated as such. Archie DLFlorio stated that conditions would not be accented by his 5 car parking. He would be selling cars at normal hours; He intended to gu~.rantee service to the cars he sold and could maintain them at the Shell station. They would be parked against the fence. Chairman Kirk asked DiFlorio what his contract consisted of with the proprietor, John McHugh. And what space was available to him. DiFlorio stated that he did not have any writtend con- tract...that he had space available per verbal agreement which measured approximately 40' from the street. Chairman Kirk stated that the Board would have to have a drawing of the proposed car parking space and the footage involved. The Board voted to take the application under advisement. They voted .to refer the matter and the complaints to Chief Lawlor and the Building Inspector requesting a report prior to the July 2k meeting. Se2ectmanGuthrie stated that he would be on vacation for the next two weeks, startu.'- Saturday, at Seabrook. If he has to be consulted, Adams Baal Estate office would get 'a message to him. The next meeting will be held on July 2k, 1972. Alice M. Letarte, Secretary. lerk JULY 2h 1972 The Board of Selectmen held their.regular meeting on this date with two members present; Selectman Joseph A. Guthrie and Chairman Arthur P. Kirk. Selectman WilliamB. Duffywas absent. GAS EXCAVATIONS: Approved were two petitions to excavate on 1253 Salem and Chestnut Streets to install gas services and repair a gas main. BURIED CABLE: A petition to install 445 feet of buried cable and ~ pedestal on Boston Rd., and 111 ft. of buried cable on Gray Rd. was set for a hearing on August 14, 1972, at 7:30 p.m. EXISTING POLES: Petition for transfer of c~nership of existing poles (2) on Osgood St. was approved. OE~IFICATE OF INCORPORATION: An affirmative character reference ~or a member of CITA, Inc. was received from Chief Lawlorl CML DEFENSE DIRECTOR: A letter was received re an award certificate for Civil Defense Director, John Coco. Board voted to have certificate framed and invite Mr. Coco, at his convenience, to attend a Select- men's meeting for presentation of the certificate. FLATLEY'DRAINAGE: The Board received a copy of letter from J. Berkover, DPW. to Thomas J. Flatley re proposed drain, on Rt. 125. Board voted copy of letter be sent to Mrs. George, Andover St. and copies of all correspondence on the matter be sent to the Highway Surveyor. Jack Erle is to contin- ue to represent the Board in this matter. HOUSING QUESTIONAIRE: The Board received a housing questionaire from Merrimack Valley Planning Commission. The Board voted to have Chairman Kirk complete the questionaire and to have copies sent to the Housing Authority and Advisory Board representative, Harold Norley.
