Kirk with Chairman Joseph A. Guthrie presiding. The warran~ and minutes were approved as submitted. POLES AND DUCTS: The Board approved petitions mo install 2 poles on Charles St. and the installation of 2-6" ducts on Charles St. JUROP~: James J. Dean, 21 Hamilton St. was drawn for Jury Duty at Salem, Oct. 1, 1973. Dorothy R. Campione, 154 Waverly Rd. was drawn for Jury Duty at Salem, Oct. 1, 1973. iDUCTS: Petition to install 2-3~' ducts on Forest St. Hearing set for Sept. 10, 1973. GAS EXCAVATION: The 'B card approved petition to excavate on 12 Spruce St. to install gas service. Approved: petition to excavate on Autran Ave. to install gas service. CEF~IFICATE OF INC.: Volunteer-In Service Program referred to Chief Lawlor for character reference. SOLID WASTE DISPOSAL: Meeting approved, requested by Merrimac Valley Planning Commission, through W. Cyr to discuss regional solid waste problem with the N. A. Solid Waste ~ommittee, and the Board of Selectmen Sept. 11, 1973, at 7:30 p.m. in the Town Building. NEW HIGH SCHOOL FENCE: Received letter and agreement authorizing the ~ownto begin fencing work specified in theForce Account Agreement a~ new High School. - LEAGUE OF WOMEN VOTE~S: Letter from Mrs. P. Slade, Study C~airman of the League of Woman Voters of N. Andover requesting permission ~o study various duties of Town Office, especially the Board of Selectmen, Board of Public Works, Highway Surveyor, and Town Clerk for their local study this year entitled, "Forms of Government." - SOHOOLC SSi, i e Board accepted with' regret, the resignation of Jane L. DRIVEWAY: Letter from C~ief Lawlor to Chairman Guthrie received in regard zo driveway of mne BLxby Associ- ates, Rt. 114. Chief Lawlor stated that he talkedwith Benjamin Osgood of the Puste Realty Co. regarding safety hazards resulting from vehicles exiting on Rt. 114 from officebuilding located at Wilsons Corner. A permit has been procured for exit and entrance signs from the Hight of Way Division of the State Dept. of Public Works. Mr. Osgood stated that he would install signs to allow vehicles to enter on to Turnpike St. only during less peak hours. He also stated, that he was .consulting Merrimack College to allow use of their driveway in the rear of his property so that vehicular traffic would leave byway of Peters St. He requested assistance from Chief lor if needed when consulting college authorities. Letter received from Atty. Victor Hatamstatinghe had discussedpotential safety hazards of. the forementioned office and~business complex with Chief Lawlor; that he was examining the and assured him of his cooperation in reducing any extraordinary hazard, if it ~m~sts, and would be pleased to meet with Chief Lawlor to examine jointly how the problem may be ~ eviated. SCHOOL GROUNDS ~ REPORT: Letter received from Chief Lawlor re the Middle School area stated that it appears activity in t this area has been working fairly well. On Aug. 28, the area was chedked at 9:40 p.m. by lynch, who reporteddebris in the area but no evidence of alcoholic beverages or containers. ndividuals who were asked to c~en up debris were very cooperatmve. A ~ur%her~heck is .to be made to ascertain the individuals who are bringing in and disposing Letter received from Highway Surveyor indicated that although the Highway Dept. has emptied barrels in diff~rent locations faithfully, in order to solve the problem,f discarded litter he feels that~the kids havelet ~he town down, not only in a sense of littering but also the contents of these barrels indicates that the drinking exists as much as ever. He feels that un- til thereis more cooperation from the kids themselves, the town willfight a losing battle. Letter received from J. Borgeai, Public Works, contends thatit is next to impossible to keep th& Middle School area policed. The problamis not the empting of the 2~ gallon barrels (one of whichwas damaged badly and had to be replaced) but rather the picking up of the area. An ee would have to be assigned to this area at least one hour each day, and with the present ~ Icad'of-the department, this is next.to impossible. He suggested aid from the Corp or some 9ther organization to help~alleviate the'problem. . S~O~ SEPTEMBER 4, 1973 (continued) GR~JNDS: Chairman Guthrie stated that cooperation has been given by the majority of the kids except for a small minority. He believes that the situation has improved since the program started and he serums encouraged with the results thus far. He recommended that Chief Lawlor speak to the oWn- ers of the Dairy Queen, Inc. because it is their trash (containers) that is for the most part littering the area. ~lso, nc parking should be allowed on the school grounds. It would help to solve the problem. Selectman Coa~ stated that there should be a stronger ordinance on the drin~i, ng problem. T~at these are public ways and grounds and the drinking should be curtailed in any such area. Selectmen agreed to evaluate a new drinking By-Law for ToWn Neeting action. Selectman Kirk believes the situation to at a 50-50% level. While driving by on occasion, it appears to him that the curfew has been observed, but that the littering still remains a problem on ~0% of the days. Frank Cunningham, Director of the Yout Council strongly recommended chastizing the~children for drinking. Plans meetings now that the school year has resumed. Robert DiSalvo believes that the action of restricting drinking on public property is a violation of peoples rights. Selectman Coady objected, saying that drinking on public should not be tolerated, that there is a time and place for everything, especially drinking. DiSalvo commented that he thought it was a police matter. The Selectmen pointed out that the Police Department's duties stem from the Board of Selectmen. DiSa~vo, however, still contended that if there wasn't any action that the current problem with the teenagers would cease. STREET LITTER: Gaton Osgood complained to the Board that Stevens St. and Academy R cad were continuously litter- ed wotJ beer cams amd bpttles and inquired as to how this problem, could be alleviated. The Selectmen contended that the laws in Massachusetts are not as strict on the problem of debris as in other States. Also, that it was not only the kids but it was the duty of everyone inthe town to cooperate in keeping our toWn clean. PRECINCT VOTERS LIST: Vacancies for Precinct Workers List to be filled by appointment will be reviewed further this week by the Board and will be discussed Sept. 10, at 7:30 p.m. in the T own Building. Guthrie stated that unless the petitions changed that the chances of the town winning in court would be very slim. The Board agre~ to authorized Town Counsel to settle case out of court wit~ petitioners if in the best interest of the town and also if the settlement were acceptable to the School Committee. LICENSING COMMISSIONERS: Hearing set Sept. 10, 1973, 7:30 p.m., Town Building, for transfer Of stock of a Retail Pkg. Goods Store, all alcoholic license from John J. Bonelli, Inc., John J. Bo~e11~, Ngr. to Daniel P. O'Neil, Mgr Hearing set for Sept. 17, 1973, 7:30 p.m., town building, for petition of Hudson Hush'Lines to operate on town streets for hourly limosine service to Logan Airport. Er. Plouffe, representa- tive of the Hudson Bus Lines was present to discuss the possible routes of the service. He stated that the service would originate in Haverhill, Mass. to Rt. 12% and stop at various spots in the North Andover area .... W.Electric, Merrimack Valley Notor Inn, Merrimack College and Other places. He pointed out that the Il-passenger limusin~would ~t stop on the hi,way but would pick passengers up on private property. POLE lOCATION: Rearing set for September 17, 1973, 7:30 p.m. on petition to locate pole on Stevens St. NEW HIGH SCHOOL: Request received from Chief Lawlor to adopt % new safety measures in the vicinity of the new High School on Chickering Rd. Board voted to forward requests to Jacob Berkever, District Highway Engineer in Danvers. Study should help prove this point, which if true, will in Selectmen ' new minimum fees for some~ Jobs.
