HcEvoy with Chairman John F. Coa~y presiding. The minutes and warrant were approved as submitted. Girl Scouts attended meeting. NOTICE OF MEETINGS: Chairman Coady invited to be a platform guest at Voc School graduation, Sunday, June 8. Joe Willis and Chief Lawlor will attend preconstructiom conference in Danvers, Wed., Juno 4 on traffic light installations on Rt. 125, Junction of Peters St ami Rt. 125, R~llside P~. Lake Cochichewick Study Committee meeting, June 17, Merrimack Valley Textile Museum. Civil Service Firefighter ex~minution, Ju~y 11-12. Copy to Chief Daw, posted on bulletin Board. M~PC: Hemo from the MVPC re town assessment. Amount $1,887.63. Letter sent to Assessor's Office. RESIGNATION: Letter from Dr. Eagene Beliveau, DDS, contained his resignation from the Board of Appeals. Board voted to send letter of thanks and appreciation for his past services to the town. NOTICES: Copy of letter to Senior Citizens announcing hot lunch program continued until June 19. Notice from C~,l ~ Oil Co. of 1 cent increase in all gasoline. FLAG DAY: Letter requesting town to celebrate and honor America from Flag Day, June 14 throught the fourth of Jv_ly. Proclamation requested. It was so voted. COUNCIL ON AGING: Kevin~;Brooks, from 'Com~,~ty Action Council, Inc. attended the Selectmen's meeting request- ing space for Council On Aging. He was ,,~re, obviously, that Mrs. l~urphy had requested same months ago. Board advised him that space problems of town offices must be solved before request given consideration. LIC~S~NG CO~MISSIONERS: Hearing, 7:45 p.m.- Application to transfer Rot~fl Package Goods Store, Wine & Malt license from De~l~u's Market, 60 Union St. to Ron's Iobster Pool, 67 Water Street. Board approved transfer of license. Approval will be sent to ABC. Hearing: 8:00 P.E. - OUt-DOor Parking license application renewal. Christopher Adams ami Atty. Xazarosian representing Adams wore present. Atty. Xazarosian contended that ~-m's non-conforming use had been established at last hearing, stated ~ding Inspector did not quote law as heshould, that l~r. Foster was unfair to his client. He also stated that he did not even think it necessary Mr. Adam's had to apply for a license from the Selectmen. Abutters Ronald Cyr ~?~ William Bassioni were present a~ stated they were in favor to the licenss. Poster: Stated that Adam's non-conforming use had not been established at last heaming, he ba---'~'-~'-black and white proof of same. License was also in violation cf zoning by-law..such a license not permitted in iminstrial zoning. Chief ~a~er: Definitely against license because of added traffic hazards it presented. oOhief Daw,: Chief Daw stated he would not approve license, not because of fire hazard, but because it was against the zoning law. - Selectman Guthrie: · Wanted to know why Chief Daw was concerned with zoning ~hich was not in his Jurisdiction. The Boar~ voted, after considerable discussion, to write letter to Town Co,,~al asking his Judgment on the following two questions: Does Fire Chief Daw have the authority to disapprove an application for an Out-Door Parking license for any reason other than those concerning his department? Does Fire Chief Daw have the authority to disapprove said license p~rticular- ly on the basis of his interpretation of the town Zoning Law? Daci~ion on matter will be made at next meeting, J,,me 16. Application received for Restaurant, ~ Alcoholic license for The W~ows, Inc. Robert P. Rogan, M~noger, a tennis club on Rt. 114. Discussion on traffic hazard re care~.exiting onto Rt. ~4 took place. Board voted to advertise hearing on,application, june 16, abutters to be notified. Selectmen will also view premises on Thursday, June 5, at 8:30 p.m. Mr. Regen stated a sign would be erected, flashing, warning persons coming from club of exit onto Rt. 114.
