McEvcy"with Chairman Joseph A. Guthrie presiding. JUROR: Elizabeth M. Enright, 7 Johnson St. was drawn for Jury duty for April 5 Sitting, at Newhuryport. SPECIAL TOW~! ~ETING: Upon a petition presented to the Selectmen by Anna Donahue, et al, with 303 certified signatures to call .a Special Town Nesting for the inclusion of two Articles, Selectman Ooady stated that "we live in a society of laws and the petitioners are entitled to their request for a Special Town Meeting." He then made a motion for a Specia.1 Town Meeting to be held on March 18, at 7:30 P.M. in the Middle School auditorium. Articles to be included and voted on are as follows: (C.opies of Articles sent to Advisory Board with inquiry of expense to town, if passed. ) 1) To see if the Town will voted that there is a necessity fox the enlargement of an existing cemetery in the town, and to direct the Selectmen, under General Laws, Chapter 114, Sec. 11, to make application to the Essex County Commissioners to acquire, for the purposes of such a cemetery, that land described in the deed from Roman Catholic Archbishop of Boston to Plan- ning Office for Urban Affairs, Inc., by deed recorded in North Essex Registry of Deeds, B.1262, 2) To see if the Town will vote to direct the Selectmen to cause an appeal to be filed, in behalf o the Board of Appe~s, from the decision of the Essex County Superior Court in Civil Action No. 2647. FEDERAL HIGHWAY ACT, 1973: Letter from Department of Public Works stating informative letter had not been received from Town to select the Federal-Aid Secondary and Urban Systems in North Andover. Subject matter had been referred to Chief Le~lor and Highway Surveyor. Mr. Oyr stated plans had not been enclosed, as stated, and that he had been in touch with the Public Works Dept. who will send another set to him. HE.~EFORD MATTER: Ietter from Planning Board informed the Selectmen that they had again voted to have Atty. D'Agostine represent them in their dispute with the Board of Appeals on the Hereford Earth Removal Permit. However, they enclosed a copy of a letter sent to the B card of Appeals asking another meeting with them to, hopefully, resolve their differnoes without going to Court for a Declaratory Judgment. The Board took both letters under advisement. ~ G.L.SANITARY DISTRICT-:']2~PLOYEES RETIREMENT: Letter from the Department of Banking and Insurance advised the Board that they had issued a certificate establishing a contributory retirement system for the Gr. Law. Sanitary District of Andover, Lawrence, Methen and North Andover. The retirement system becomes operative on July l, 1976 for the employees of the district and all eligible employees of such district become mebere of the Lawrence Retirement System. The Board voted to send letter to Tows Oo,,n, el stating that if these employees become members of the Lawrence Retirement System, the Town of North Andover should have no responsibility to iband the retirement system of said employees. HOUSING ASSISTANCE: Louis Minicmoci, appeared before the Board to explain the low income housing planned for this year as soon as the Selectmen approved and application for funds for subsidized housing was sent to the Dept. of Housing and Urban Development. Besides elderly housing, couples with families with Iow incomes would have their rent partially paid for enabling them to stay in decent housing. It would be operated ,,~er the N. A. Housing Authority who would use incomes of applicants as their g~idetines. The Board voted to write letter to W. H. Hernandes, Jr., Area Office Director, Dept. of Housing and Urban Development stating their unanimous endorse- ment of the Housing Assistance Payments Program, Sec. 8. Selectman ~Evoy moiled letter. PENSION ~o~ND APPROPRIATION: Letter received re 1976 County Pension Fund Appropriation. Selectman Coady motioned to have the Board appoint a Retirement Study Committee by the end of April to study the feasibility whether or not North Andover should continue in the Essex County Retirement System. He stated that the system, technically, is operated under good, prudent procedures but would like it de- termined if a retirement system of their own would be of mere benefit to the town. It was so voted. Letter from County Flanner, T. O'Leary, thanking Board for dues payment for Essex Cty. Historic & Scenic District Planning Commission. Request for applications for participation in an energy management program from Dept. of Community Affairs. Board took request under advisement. HIGHWAY SURVEYOR: Letter from Bud Cyr stated that he would like to continue educating perople in the havit of re- cycling and recyclable collection stations be made available to our Townspeople. It would minimize the town's rubbish and waste cost. He would like stations behind town building and garage.
