The issue to be addressed Edqewood Life Care - Special Permit~ There are three applications and decisions to be made. Those decisions are for Special Permit, CCRC, PDD and Site Plan Review. The Board members added to the drafts that all relevant approvals must be obtained prior to issuance of building permits. Incorporated into the decision will be concerns of the D.P.W. which are addressed in a letter from Bill Hmurciak. Covenants will be attached. Easements granted to the Trustees of the Reservation. Housekeeping, in language was done on Condition #5, Condition #17 and Condition #20. Motion: Second: Vote: Note: By Paul Hedstrom to approve the Special Permit Drafts for Site Plan Review under Section 8.3; Section 13, Continuing Care Retirement Center; and Section 11.3, Planned Development Districts per discussion and drafts as marked up and directing the Planner, Chris Huntress to put in final form as discussed. Erich Nitzsche Unanimous of those present. Decision is part of minutes. Boston Hill Ski Area - PRD Christian Huntress, Planner gave the Board copies of a draft decision for Boston Hill Ski Area, PRD. A letter was received from the applicant requesting an extension from the Board rendering a decision. The applicant would like to review the residential sprinkler system with the Fire Chief, Bill Dolan. Chris Huntress went over Condition #6 relative to building model units and the drainage. Construction of the roadway and the model units only to be done at the same time. Erich Nitzsche asked how many units were involved. Chris said that there were two structures for a total of eight (8) units. No other structures will be built until the roadway is complete. The erosion will be controlled. The North Andover Planning Board held a meeting on September 28, 1989 in the Town Hall, Selectmen's Meeting Room. The meeting was previously scheduled for October 5, 1989, but due to a Special Town Meeting, the Planning Board meeting was rescheduled. The meeting was called to order at 9506 p.m. by the Chairman, George Perna, Jr. Also present were John Simons, Clerk; Erich Nitzsche and Jack Graham. Public Hearings Riparian Realty Trust - Site Plan Review John Simons read two letters from the applicant requesting an extension in which the Board must act until October 26, 1989. Motion= Second: Vote: By John Simons to accept the extension until October 26, 1989. Erich Nltzsche Unanimous of those present. Note: The Board requested that the Planner, Chris Huntress, get a footprint of the buildings from the applicants. Sideri - Special Permit - Watershed District John Simons read a letter from Attorney Domenic Scalise requesting an extension on the time in which the Board could hold a public hearing. The request was being made due to the Special Town Meeting. Motion: Seconds Vote: Decisions By John Simons to accept the extension to October 19, 1989 for the purpose of holding a public hearing. Erich Nitzsche Unanimous of those present. Boston Hill Ski Area - PRD The Board went over the draft decision. Chris Huntress, Planner, asked the Board to review Conditions 22, 23 and 24. John Simons asked who was going to hold the Conservation Restriction Easement. Would the easement be to the Town of North Andover, Trustees of the Reservation or the Conservation Commission. The Board added to Condition #22: Prior to the commencement of construction, the applicant shall submit an easement, in proper form, for Planning Board approval for the open space. On Condition ~23, relative to the phasing plan, the language was made clearer. On Condition #24, relative to the waterfall, the Chairman would like to be informed of staffs decision. Also added to the condition, after the words Department of Public Works add and the Conservation Commission. John Simons commented on Condition #17, bonding. A provision will be added after the words site screening, for bonding of erosion control. Also added to the condition after the words Tri-Party Agreement, or passbook. South Cross Definitive Modificatio- Bill Hmurciak asked that plans be provided which show the concerns of the Department of Public Works have been addressed. Added to the draft decision was Condition #20~ Prior to an issuance of a Certificate of Occupancy to Lots 1, 2, and 4 the Planning Board shall require the developer to provide an engineers certification that the driveways have been properly crowned and graded so as to assure the Planning Board that no street drainage will flow down the driveways to the wetland and/or dwellings, said certification to approved by the Planning Board. Also added to the draft was Condition #21: Prior to the Planning Board endorsing the Final Definitive Plans, the full set of plans shall be submitted to and approved by the North Andover Department of Public Works. Jack Graham Unanimous of those present. the draft decision as APProval Not Required Porm A Plans Wiley Court Motion: Second~ Vote: By Erich Nitzsche that the Planning Board find Wiley Court Form A to be a subdivision under Chapter 41 and not endorse the Form A Plan as submitted because in the opinion of the Planning Board Wiley Court does not have the proper construction or width and in accordance with the Planning Board Rules and Regulations and therefore the Board finds that it an unacceptable way for the construction of a dwelling. Discussions Recommendations, Special Town Meeting, October 5, 1989 Davidson Easement Motion, By Erich Nitzsche to recommend favorable action for the Special Town Meeting, October 5, 1989 for the driveway easement to be granted. George Perna spoke to the Board members on attending Town Meetings and the necessity. A discussion to place on the recommendation to grant the easement. Erich Nitzsche withdrew his motion. Motion= Second= Vote~ By Erich Nitzsche that the Town recommend the granting of a driveway easement for the Davidson Property across Lot 7 owned by the Town of North Andover, said driveway easement to be the width of the existing driveway plus five (5) feet on either side for shoulder said right to maintain, repair or reconstruct.
