BACKGROUND On April 21, 2015, Bruce Thibodeau, Director Department of Public Works, requested a Waiver of the Watershed Protection District Special Permit, in accordance with the North Andover Zoning Bylaw section 4.136.8, for the purpose of reconstruction of Rea's Ponds Wastewater Pump Station within the Non-Disturbance Buffer Zone of the Watershed Protection Zone. The Project entails the relocation of existing wastewater pump station outside of the 50' No-Build Zone, as well as outside of the FEMA Floodplain. The new station is designed to support the seasonal high and low flow variations with improved capacity and wastewater storage, and enhance redundancy and resilience with an updated electrical service, backup controls and standby power. FINDINGS OF FACT, • A stormwater BMP was submitted to provide control and treatment of stormwater runoff, as per the Ma Stormwater Management Standards and the Town of North Andover Bylaw Standards. • The pumping station will continue to convey wastewater to a location outside of the Watershed Protection District. • The new pump station will be secured with a perimeter fence. • The existing pump station will be demolished with the existing footprint and the existing gravel area reconfigured to provide parking for those using the area for recreational purposes. • All area other that the proposed structures and proposed driveway will be replaced with grass or other native plantings. • A wastewater pumping station is an allowed use within the Non-Disturbance Buffer Zone. DECISION After discussion at the April 21, 2015 Planning Board meeting, and upon a motion by D. Kellogg, seconded by L. McSherry, the Planning Board Approves the Watershed Special Permit - Wavier with conditions. A vote of 4-0 was made in Favor of the waiver request. CONDITIONS • The Town Planner will conduct a minimum of two site inspections during the construction • The Town Planner will have the authority to stop construction if it is determined that proper erosion control is not in place.
