HomeMy WebLinkAbout2015-05-11 Board of Selectmen Minutes w/documents BOARD OF SELECTMEN MINUTES May 11, 2015 CALL TO ORDER: Chairman Richard Vaillancourt called the meeting to order at 7:00 PM at Town Hall Meeting Room. The meeting was recorded. ATTENDANCE: The following were present: Chairman Richard Vaillancourt, Clerk Rosemary Smedile, Licensing Commissioner, Tracy Watson, Donald Stewart, Phil DeCologero, Town Manager Andrew Maylor, Assistant Town Manager Ray Santilli and Executive Assistant, Laurie Burzlaff. Approximately 10 members of the public were in attendance. PLEDGE OF ALLEGIANCE: Chairman Vaillancourt introduced Abigail Karalis, Junior Poet Laureate who led the group in the Pledge of Allegiance. APPROVAL OF MINUTES: Tracy Watson made a MOTION, seconded by Rosemary Smedile, to approve the Open Session Minutes of April 27, 2015 Vote approved 5-0. COMMUNICATIONS AND ANNOUNCEMENTS: Introduction of new staff member-Kristine Cheetham, Town Planner Eric Kfoury, Director of Community and Economic Development, introduced the new Town Planner, Kristine Cheetham. Update from Karen Kline, Poet Laureate Karen Kline, North Andover's Poet Laureate, discussed the Junior Poet Laureate position. The Junior Poet Laureate is helping Ms. Kline with the poetry program at the elementary schools. Ms. Kline introduced Mary Gregoire, District Humanities Curriculum Coordinator, who organized the Poetry Reception at the Library and the Poetry Jam at the High School. Ms. Kline presented the Junior Poet Laureate, Abigail Karalis, with the Junior Poet Laureate Award. Miss Karalis read her poem entitled "March Madness". Earth Day Clean Up Acknowledgment Chairman Vaillancourt read the names of the groups and individuals that helped clean up various parts of the town on Saturday, May 2, 2015, per the memorandum of DPW Director, Bruce Thibodeau. Update on West Mill-RCG, LLC David Steinbergh of RCG, LLC gave a power point presentation regarding RCG's plans for the West Mill on High and Water Streets. Seth Zeren, Development Manager of RCG, LLC was also present. The plan is to add residences and businesses and remove the middle building, which is not an historic building, and make that area a parking lot. The Board had a brief discussion about a stop sign at Elm, Water and High Street, which will be discussed in greater length at an upcoming meeting. Karen Kline provided public comment stating she is in favor of the stop sign as she sees elementary kids trying to cross that street. Eric Kfoury announced that the Town has entered into an agreement with RCG for an additional stop for the commuter bus to Boston in the parking lot on High Street. Environmental Partners-Impact Study of Biosolids Project at GLSD Robert Rafferty of Environmental Partners, provided a summary of his findings and recommendations regarding the potential community impacts of the proposed Biosolids Project at the Greater Lawrence Sanitary District. In response to a question from the Board regarding whether North Andover would be overburdened, Mr. Rafferty explained that to take in any more load than GLSD has predicted, would require a major expansion of the facility. He believes there will be some competition in this area and GLSD should take that into consideration when estimating load intake. Town Manager, Andrew Maylor, recommended forwarding the report to the GLSD, highlighting the findings related to the financial and contractual considerations. Mr. Maylor explained that he will add to the host agreement amendment the Board of Selectmen Minutes May 11, 2015 2 recommendations of the report and a clause relative to no idling and have the amended agreement reviewed by legal counsel. Other communications and announcements: Sheep Shearing on Sunday from 10-4 at the common and no dogs are allowed during the event. May 19th is the Annual Town Meeting at 7:00 pm at the High School. There is a continuous loop on North Andover CAM discussing Town Meeting warrant. The warrant is available on the Town website, at Town Hall and will be available at Town Meeting. June 16th from 6-8 p.m. is the Open House for the new School Administration Building. Special Olympics is at the High School on May 20th at 8:30 a.m. May 17th is the Alex Farese annual track meet. May 14th is the public meeting for feedback on the Town Hall fagade and courtyard. CONSENT ITEMS: Affordable Unit resale-21-larvest Drive, Unit 105 (Oakridge Village) The Citizens' Housing and Planning Association (CHAPA) has notified the Town that the affordable housing unit at 2 Harvest Drive, Unit 105 (Oakridge Village) is up for sale. It is recommended the Board not exercise its right of first refusal. Tracy Watson made a MOTION, seconded by Phil DeCologero, that the Board of Selectmen decline the right of first refusal to purchase the affordable housing unit at 2 Harvest Drive, Unit 105(Oakridge Village). Vote approved 5-0. Request to dispose of surplus equipment-DPW Per the town policy regarding surplus material and equipment, a memorandum was submitted to the Board from Bruce Thibodeau, Director of DPW. Tracy Watson made a MOTION, seconded by Rosemary Smedile, that the Board of Selectmen approve the request of DPW Director, Bruce Thibodeau, to surplus the 2002 Chevy Silverado F350 and the 2002 John Deer Tractor with attachments per his memo to the Town Manager dated April 29, 2015. Vote approved 5-0. Request from Patriotic Observance & Marching Committee to hold Memorial Day Parade on Monday, May 25, 2015 at 10:00 a.m. Ted Tripp of the Patriotic Observance and Marching Committee submitted a request to the Board to hold the annual Memorial Day Parade on May 25, 2015 starting a 10:00 a.m. The parade will be from Osgood Street to Mass Avenue to Salem Street ending at Ridgewood Cemetery. Rosemary Smedile made a MOTION, seconded by Phil DeCologero, that the Board of Selectmen approve the request of the Patriotic Observance and Marching Committee to hold the annual Memorial Day Parade on May 25, 2015 beginning at 10:00 a.m, on Osgood Street. Vote approved 5- 0. Appointment to Elderly/Disabled Taxation Fund Committee-Richard Gramly The Board's appointment subcommittee recommended Richard Gramly be appointed to the Elderly/Disabled Taxation Fund Committee. Phil DeCologero made a MOTION, seconded by Rosemary Smedile, that the Board of Selectmen appoint Richard Gramly to the Elderly/Disabled Taxation Fund Committee for a term ending June 30, 2017. Vote approved 5-0 Vote maximum useful life of equipment-bond authorization The 2014 Annual Town Meeting approved the Capital Improvement Plan for Fiscal Year 2015. By statute, the Board is required to establish the maximum useful life of equipment bonded for a period of more than five years. Tracy Watson made a MOTION, seconded by Rosemary Smedile, that the Board of Selectmen vote that the maximum useful life of the departmental equipment listed below to be financed with the proceeds of the borrowing authorized by the vote of the Town passed May 20, 2014 (Article 23)is hereby determined pursuant to G.L. c.44, §7(9) to be as follows: Line Amount Description Useful Life 9 $160,000 6-Wheel Dump Truck 10 Years Vote approved 5-0. Board of Selectmen Minutes May 11, 2015 3 Requests by Columbia Gas of Massachusetts In accordance with M.G.L. c164 §70, the Board must give consent to the gas company to `dig up and open the ground in any of the streets, lanes and highways of a town.' The Department of Public Works recommends approval for these projects. To excavate at 75 Summer Street to install new gas service Tracy Watson made a MOTION, seconded by Donald Stewart, that the Board of Selectmen approve the request of Columbia Gas of Massachusetts to excavate at 75 Summer Street for the purpose of installing new gas service. Vote approved 5-0. To excavate at 79 Hewitt Avenue to install new gas service Tracy Watson made a MOTION, seconded by Donald Stewart, that the Board of Selectmen approve the request of Columbia Gas of Massachusetts to excavate at 79 Hewitt Avenue for the purpose of installing new gas service. Vote approved 5-0. LICENSING COMMISSIONERS: Rosemary Smedile made a MOTION, seconded by Phil DeCologero, to open a meeting of the North Andover Licensing Commission. Vote approved 5-0. Armen Jeknavorian of St. Gregory's Armenian Men's Club requests a One Day All Alcohol license for a Cigar Night on Thursday, June 18, 2015 from 6:00 p.m. to 11:30 p.m. and waiver of fee Donald Stewart made a MOTION, seconded by Rosemary Smedile, that the Board of Selectmen, acting as Licensing Commissioners, approve the One-Day All Alcohol License request for St. Gregory Armenian Men's Club for a Cigar Night on Thursday, June 18, 2015 from 6:00 p.m, to 11:30 p.m, and waive the license fee. Vote approved 5-0. Vote approved 5-0. Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt, to close a meeting of the North Andover Licensing Commission. Vote approved 5-0. OLD BUSINESS: None NEW BUSINESS: None PUBLIC COMMENT: Stan Limpert of the School Committee announced the High School graduation will take place on June 5th at 6:00 p.m. and Scholarship Awards Night is on June 4th at 6:30 at the High School Auditorium. Mr. Limpert stated the School Committee is hoping to have their meeting on June 18th at the new School Administration Building. TOWN MANAGER'S REPORT: Ask the Manager There were no questions submitted. Town Manager, Andrew Maylor, explained that Boxford Street from the Town Line has been paved but a section has been left unpaved because there is a new subdivision being built. The road will be paved once the work in the road related to the new subdivision has been completed. Update on Brook Street Town Manager, Andrew Maylor, updated the Board on the road blockage of Brook Street entering from Route 114. This is a private way not a public roadway. The Town has blocked the road because flooding occurs and they do not want any cars to get stranded when it floods. In the long term, the Town will need to work with the property owner to come up with a solution. ATTENDANCE: The following were present: Chairman Richard Vaillancourt, Clerk Rosemary Smedile, Licensing Commissioner, Tracy Watson, Donald Stewart, Phil DeCologero, Town Manager Andrew Maylor, Assistant Town Manager Ray Santilli and Executive Assistant, Laurie Burzlaff, Approximately 50 members of the public were in attendance. PLEDGE OF ALLEGIANCE: Chairman Vaillancourt introduced Eagle Scout Derek Naehle, and members of Troops 86 and 87- Drew Phaneuf, Aaron Connolly, Riley Horne, Colin Horne and Michael Tringale-who led the group in the Pledge of Allegiance. Drew Phaneuf asked the Board if the Town could move the soldier statue in front of the old police station to Patriot's Park. Chairman Vaillancourt indicated the Board will look into the matter and discuss in greater detail at another meeting. APPROVAL OF MINUTES: Rosemary Smedile made a MOTION, seconded by Donald Stewart, to approve the Open Session Minutes of April 14, 2015 Vote approved 5-0. COMMUNICATIONS AND ANNOUNCEMENTS: Proclamation-Armenian Remembrance Day Rosemary Smedile read the Proclamation of the Board proclaiming April 28, 2015 Armenian Remembrance Day. The Proclamation was presented to Dro Kanayan and Father Stephan Baljian of St. Gregory's Armenian Church. Certificate of Achievement for Excellence in Financial Reporting for FY14 The Certificate of Achievement for Excellence in Financial Reporting for FY14 has been awarded to the Town of North Andover by the Government Finance Officers Association (GFOA) for its comprehensive annual financial report. The Town Manager recognized'Lyne Savage, Finance Director, for her excellent work on a daily basis. This is the third year the Town has received this award. Recognition of Derek Naehle for Eagle Scout Project Rick Gorman, Director of Youth &Recreation Services, introduced Derek Naehle. The Board presented Mr. Naehle of Troop 79 with a Certificate of Recognition for his Eagle Scout Project which was designing and constructing 2 lifeguard chairs for Stevens Pond. Selectmen meeting schedule for June-December 2015 The proposed meeting schedule for June-December 2015 was discussed by the Board. The Board agreed to the dates presented and indicated they will adjust the dates if the need arises. Richard Vaillancourt announced the'Pristash Award Ceremony is Thursday night at North Andover Country Club from 6-9 pm and tickets can be purchased at Rose & Dove. The Town Manager announced that the Town Meeting Warrant has been printed and available in the Town Clerk's office. Town meeting is Tuesday, May 19th at 7:00 pm at North Andover High School. CONSENT ITEMS: Accept donation from Derek Naehle of 2 lifeguard chairs for Stevens Pond The Board was asked to accept the donation of 2 lifeguard chairs for Stevens Pond from Derek Naehle. Donald Stewart made a MOTION, seconded by Tracy Watson, that the Board of Selectmen accept the donation from Derek Naehle of two lifeguard chairs to be used at Stevens Pond. Vote approved 5-0. Event Requests Board of Selectmen Minutes April 27, 2015 2 Museum of Printing-close Massachusetts Avenue in front of museum on June 21 from 10am to 4pm for 12th Annual Printing Arts Fair The Board was asked to approve a request from the Museum of Printing to close Massachusetts Avenue in front of the Museum on June 21, 2015 from 10am to 4pm for the annual Printing Arts Fair. All relevant town departments recommended approval. Tracy Watson made a MOTION, seconded by Donald Stewart, that the Board of Selectmen approve the request of the Museum of Printing to close Massachusetts Avenue from Academy Road to Osgood Street on June 21, 2015 from 10am to 4pm for the annual Printing Arts Fair. Vote approved 5-0. Neurofibromatosis Northeast- use streets in North Andover for 5th Annual Coast to the Cure bike ride on September 12, 2015 The Board was asked to approve a request from Neurofibromatosis Northeast to use streets in North Andover for the 5th Annual Coast to the Cure Bike Ride on Saturday,,September 12, 2015. The three routes (24, 66 or 100 miles)will all start and finish at Stage Fort Park in Gloucester. The streets in North Andover that are on the route are: Salem, Ingalls, Forest, Boxford, Foster, Winter and Dale. Diana Flahive was present to answer questions. All relevant Town Departments recommended approval. Tracy Watson made a MOTION, seconded by Donald Stewart, that the Board of Selectmen approve the request of Neurofibromatosis Northeast, to use streets in North Andover for the 5th Annual Coast to the Cure Bike Ride on September 12, 2015. Vote approved 5-0. Stevens Pond Update and 2015 fees Rick Gorman, Director of Youth & Recreation Services gave the Board an update regarding Stevens Pond and presented the Board with his recommended fees for 2015,! Mr. Gorman indicated fees have not increased in several years and recommended an increase in all fees except swimming lessons and daily adult passes. Mr. Gorman indicated that'revenue is down because of the algae situation two years ago which forced the pond to close; however,''he is optimistic that revenues will increase this year. In response to a question from the Board, Mr.'Gorman indicated that there would be no cut in services should the Board decide to keep the fees the same as last year. Rosemary Smedile made a MOTION, seconded by Donald'Stewart, to keep the fees at Stevens Pond for 2015 at the current 2014 rate, Vote approved 5-0. Rick Gorman announced the children's shows and concerts will be on the Common again this summer. Request by Community Development to waive permit fee for Machine Shop Village signs Included in the agenda,packet was a memo from Jean Enright, Assistant Director of Community Development, requesting a waiver of all permit fees for signs for Machine Shop Village. Tracy Watson made a MOTION, seconded by Rosemary Smedile, that the Board of Selectmen waive all sign permit fees for`Machine Shop Village'signs. Vote approved 5-0. The Town Manager acknowledged Eric Kfoury Director of Community and Economic Development and Jean Enright, Assistant Director, for their efforts during the transition of the Community and Economic Development Department. Board of Selectmen Minutes April 27, 2015 3 Tracy Watson made a MOTION, seconded by Phil DeCologero, that the Board of Selectmen decline the right of first refusal to purchase the affordable housing unit at 7 Ciderpress Way, (Meetinghouse Commons). Vote approved 5-0. Town Meeting Warrant Recommendations (Zoning Articles) The Board was asked to vote their recommendation on Articles 9-12. Jean Enright reviewed the Zoning Articles for the Board. Article 9 is to create a sub-district in the Downtown Overlay District to allow for separate design criteria for the mill buildings. Lynne Rudnicki of the Planning Board indicated the Planning Board has recommended favorable action. Article 10 is the map change that is associated with Article 9. Mr. Maylor also announced the goal to increase the number of Twitter followers to 2016 by 2016. Mr. Maylor announced that preliminary work is being done at Bradstreet for demolition of the building. The demolition permit has not been issued yet. Mr. Maylor said there seems to be some speculation that there was an error in the placement of the playground structure at McEvoy Field. There was no error and the structure will not be moved. The fields were designed for younger kids so there shouldn't be any issues with balls hitting the playground. The field is scheduled to open in September. In response to a question from the Board, the Town Manager indicated that trees at Stevens Estate have been cut as part of the clearing program to promote growth. The Greater Lawrence Sanitary District ({]LSD) presents ooniqoo opportunity for siting on organics- to—energy facility because of its design. It is one of the very few Massachusetts facilities with anaerobic digesters combined with power production and beneficial ro'000 of the processed vrooto sludge. Expanding the {]LSD facility by adding another digester will enable the {]LSD to accommodate up to 40% of the projected organic waste in Massachusetts. The attached Letter Report presents our recommendations to mitigate the potential impacts. The potential impacts should be addressed bv {]lSD as specific action items inthe further development of the project to keep North Andover's concerns at the forefront of the GLB0`y program. GLB0`y proposed solutions should be communicated huthe Town of North Andover. Environmental Partners recommends additions to the Host Agreement Amendment or to {]lSD`y design scope to address the potential community and environmental impacts presented inthe Letter Report. The loUor Report also provides technical and financial concerns for consideration by the {]LSD Connnniooionom and the Town Manager, as o Commissioner, related to the long toon viability of the facility. The {]lSD`y primary function, to properly protect vro1or quality and its member communities, should be kept as the overriding priority. This letter report presents our findings and recommendations regarding the potential community impacts of the proposed organic waste processing program at the Greater Lawrence Sanitary District (GLSD) wastewater treatment facility. The Town of North Andover Board of Selectmen wishes to assess the potential community and environmental impacts of the expansion of operations and processing of organic waste. In addition to these impacts, Environmental Partners assessed topics of interest to the GLSD Commissions concerning the technical merits and viability of the proposed facility. Project Understanding The Greater Lawrence Sanitary District (GLSD) is proposing to expand its operations to include an additional Anaerobic Digestion/Energy Recovery Facility (Facility) to accommodate pre- processed source separated organics (PSSOs). The GLSD has issued a Request for Proposals/ Quotes (RFP/Q) for waste haulers/processors to deliver organic waste slurry to the GLSD's treatment facility on Charles Street in North Andover. In summary, the presentation of costs, power generation potential, and wastewater treatment impacts appears to be thorough and as comprehensive as can be expected at this stage of project development. However, there are technical feasibility, cost, and market condition risk factors that need closer examination. At this point, the focus of the work has been on the potential energy production, financial payback, design of the Facility, and funding of the project. The potential community impacts that will arise need to be quantified and mitigated, and appropriate mitigation measures must be included in the overall design of the project. The pilot testing program is a key "next step"before this project advances too quickly. Evaluation of Community and Environmental Impacts Environmental Partners assessed the potential community impacts to North Andover and provides recommendations for each impact: 1. Odor at the treatment facility and along the trucking route • Findings o The transfer of PSSO from trucks to the facility is the most probable source of odor. The PSSO slurry is approximately three times thicker than typical septage and therefore will take longer to offload. The offloading of the PSSO from the truck carriers could take up to one hour each, which is 3 to 6 times longer than a typical septic truck. If the projected 15 trucks per day of PSSO are accommodated within an 8 hour work day, they would be engaged in offloading for the entire working day, increasing the risk of spills and odor releases. • Recommendations • Prior to final execution of a contract with a PSSO supplier, the offloading/receiving methods should be finalized. Only enclosed tanker truck carriers with hose connections to the receiving tanks should be allowed. • The biofilter system should provide enough negative pressure to draw odorous air into the holding tanks in case of accidental disconnects. 2. Visual • Findings • The location of new digester facilities should is not likely to cause new visual impacts because the proposed facilities are within the footprint of the existing plant. • The Preliminary Design Report (2015) does not recommend a new structure for biogas storage. However, it does present the possibility that a storage tank could be built in the future. In Technical Memorandum 5, the biogas storage tank is f "'Illlf " VIII kZI Partri r —111 Mr.Andrew Maylor May 8,2015 Page 3 envisioned to be 81 feet wide by 66 feet high. For comparison, the anaerobic digesters have a height of approximately 40 feet. • Recommendations o A full visual assessment should be completed with community input prior to planning for biogas storage. 3. Trucking and Delivery • Findings • Tanker truck traffic will increase, but the route mapped to the facility is the least disruptive of the alternatives. The proposed amendment to the Host Agreement will limit PSSO truck traffic to 15 trucks per day on average. • Additional chemicals, and chemical deliveries, will be needed because of the treatment process changes. Specifically, the preliminary design report identifies ferric chloride for digester odor control, polymer for dewatering, and caustic for increased alkalinity to offset aeration system demands. • Truck wait times will increase due to the slow unloading times for the PSSO vehicles. It is highly probable that septage haulers will be delayed at the receiving stations. • Recommendations • Additional truck traffic resulting from process changes such as increased chemical deliveries should also be quantified and provided to North Andover for consideration. • The frequency of truck deliveries to the septage/organics receiving stations should be addressed through a delivery analysis to eliminate excessive idling, noise and the potential for odor release. • The GLSD should evaluate a third receiving station dedicated to septage deliveries to accommodate the maximum number of PSSO delivers without impacting septage haulers. 4. Noise • Findings • The additional equipment and machinery will be housed within buildings and is not expected to cause excessive noise beyond what is currently normal. Some machinery will be operated for extended periods, including during hours not customary under existing conditions. • The increased frequency of truck deliveries will increase noise to and within the facility. • Recommendations o Noise issues during non-work hours can be exacerbated because of lower levels of neighborhood ambient noise. Assurances should be provided that twenty-four hour operations of equipment will not cause noise levels to increase beyond the boundaries of the facility. f "'Illlf " 11111 kZ Partri r ­111 Mr.Andrew Maylor May 8,2015 Page 4 o Strict limits on delivery times, as detailed in the proposed Host Agreement Amendment, should be adhered to. Truck idling should be prohibited. 5. Biofilter Capacity for Odor Treatment • Findings • The airflow to the biofilter is currently slightly less than the designed capacity of the system, with some reserve capacity available for periods of additional air flow. • CDM Smith recommends reducing the air flow from each of the odorous spaces handled by the biofilter by 10% to 12.5% to allow new sludge storage tanks to be added without expanding the biofilter. The consequences of reducing the airflow from the current spaces are not completely defined or tested. Rebalancing of the system will be a work in progress and odors are possible during the transition period until the system is properly balanced. • Recommendations o GLSD should assess the cost and feasibility of additional odor control methods in case the re-balancing of the existing system does not produce the expected results. Host Agreement Amendment and RFP/Q Compatibility The RFP/Q allows PSSO truck deliveries 7 days per week from 5:00 a.m. to 10:00 p.m. The Preliminary Design Report anticipates a 6 day delivery schedule in agreement with the Town's draft Host Agreement Amendment, which seeks to limit deliveries to 7:00 a.m. to 5:00 p.m. Monday through Friday and between 8:00 a.m. and 5:00 p.m. on Saturday. Septage receiving hours are from 7:00 a.m. to 6:00 p.m., Monday through Saturday. The schedule of deliveries could have an effect on the intended continuous digester operations and availability of receiving facilities. The Agreement with the GLSD's supplier should be consistent with North Andover's Host Agreement Amendment to mitigate quality of life impacts. In addition to the limits on organics supply deliveries, Environmental Partners recommends additions to the Host Agreement Amendment or to GLSD regulations and guidelines to address the other potential community and environmental impacts presented in this Letter Report. Section 6 of the RFP/Q addresses PSSO quantities to be delivered by the Supplier to GLSD during the piloting to full operations. Paragraph 3 states, "Any increases to required delivered volumes will be mutually agreeable between the GLSD and the Supplier." We do not believe this provision is effectively protective. The inclusion of these topics is not intended to be exhaustive or the result of a thorough peer review of the preliminary design. Instead, these topics are presented for consideration as a result of our general review of the project's documents. The financial assessments presented in the documents appear to be optimistic scenarios, assuming maximum digester loading and biogas production. A sensitivity analysis that adjusts critical assumptions would provide the GLSD and its member communities with a more realistic expectation of the return on its investment. CDM Smith's Technical Memorandum 7 (2013) recommended a limited program using the GLSD's existing digesters without construction of a fourth digester because of the "inherent risk related to waste availability and the expected variable market for this material in the Commonwealth over the coming few years". While the 2014 organics waste ban has created new sources of waste material, the Preliminary Design Report does not provide quantitative data that addresses CDM Smith's initial concern with the effectiveness and quality of the thermal drying operation (pellets) or the potential competition for the organic waste. CDM Smith cites, "These impacts of co-digestion have not been widely studied and would require further analysis as part of a co-digestion program at GLSD." Therefore, the uncertainties put forward by CDM Smith should be further explored. The following financial and contractual topics should be considered as the Facility undergoes piloting, and before final design efforts are undertaken. 1. A detailed market based sensitivity analysis should be conducted in recognition of the potential for competition for organic waste. It is our understanding that the MWRA plans to use one of its digesters to pilot 50 to 100 tons per day of organic waste. This is between 40% and 80 % of the projected state-wide organics waste load. Considering that the proposed GLSD facility is projected to process up to 40% of the state's organic waste at full build-out, the risk of not consistently obtaining full loading should be evaluated. 2. The financial consequences of producing power and pellets should be assessed at various scenarios assuming disruptions in supply or demand, and the possibility that the new digester systems will not operate at peak efficiencies. 3. Contractual protections should be put in place to ensure the reliable delivery of the necessary quantity of organic waste to the Facility until at least the financial break-even point is reached. f "'Illlf " VIII kZ1 Partri r ­111 Mr.Andrew Maylor May 8,2015 Page 6 Treatment Process Considerations In any treatment process, each process unit has a range of operating parameters within which it operates most effectively, efficiently and reliably. Environmental Partners notes several instances where the preliminary design report proposed changes to the existing operating conditions. While these changes are within or near standard ranges, the treatment processes lose some of the buffer for variations in process conditions. The assumption that the compilation of these changes will not cause some adverse impact to the treatment operations is somewhat optimistic. The following topics should be specifically addressed during piloting and reported to the District communities. 1. Compliance with the GLSD's NPDES permit. • Findings • CDM Smith notes that the ammonia load to the aeration system will increase, but that a large industrial contributor to the facility is "relocating outside of the services area in late 2015"to offset this load. • GLSD's current discharge permit with the EPA has expired, which is not an unusual occurrence. However, newly issued EPA permits are generally more restrictive and are trending toward limiting the discharge of nutrients to impaired water bodies. The Merrimack River is impaired in the vicinity of the discharge location because of excessive phosphorus, a nutrient in plentiful supply in organic waste. • Recommendations • A more conservative scenario should be considered. The current conditions should be assessed without projections of beneficial changes so the facility's primary mission of treating the service area's wastewater is prioritized. • It is possible that that GLSD's next discharge permit will restrict the levels of phosphorus to the Merrimack River. GLSD should understand, at least conceptually, whether the new digester process will cause additional costs or operational concerns if a more restrictive permit is issued. 2. Treatment Process Capacity • Findings o According to CDM Smith's analysis, the downstream and side-stream process equipment appear to be designed to adequately treat the projected new loads, although the wear and tear of the equipment will increase, which reduces the expected life span of the equipment. Therefore, long term operations and maintenance cost will increase. • Recommendations o Greater maintenance costs and staffing efforts are included in the Preliminary Design Report. However, some caution should be exercised. Treatment Process Operations • Findings o Because of the high volatile solids content of the PSSO, the load to the digesters could approach 0.20 pounds per cubic feet per day (lb/ft/day), which is greater than the historically accepted range. In the Preliminary Design Report, CDM Smith notes recent studies and operating facilities have increased the load to "approach almost double" the accepted range. However, CDM Smith does not provide references or further supporting information. In its Technical Memorandum Report, CDM Smith raised some concerns with operations at this concentration of solids. • Recommendations o This issue should be fully assessed. The design of the initial piloting program should define how the program will mimic actual conditions under full scale operation. Loading under full scale operations is based on a blend of the organics sludge (thick) and wastewater sludge (thin). One key concern is whether the piloting program can reliably and consistently achieve the intended slurry thickness to demonstrate the proof of concept. 4. Project Schedule • Findings o Conducting piloting while designing the full scale facility introduces the risk of design changes late in the process to accommodate the results of the piloting. This schedule does not provide a buffer of time between piloting and construction. The schedule seems more condensed than is prudent given the technical uncertainties. • Recommendations o Understanding that the schedule in condensed to accommodate the funding schedules, the GLSD's design consultant should create a stringent and detailed piloting program that prioritizes the critical components that govern a successful process. Summary of Recommendations There is a risk of increased odor from the facility. The Preliminary Design Report addresses most issues, but the potential for odors from the receiving facility and from queued truck carriers should be evaluated. Solutions to these risks must be communicated to the North Andover Board of Selectmen. Other community "quality of life" impacts, such as noise, traffic, and other potential disruptions, appear to be resolvable with the GLSD's attention to North Andover's concerns. f "'Illlf " 11111 kZ Partri r —111 Mr.Andrew Maylor May 8,2015 Page 8 Larger issues related to the long term viability of the facility are in the domain of the GLSD Commissioners. A comprehensive business case would define the strengths, weaknesses, opportunities and threats to the organic waste digestion business. Specifically, the financial consequences must be tested at various scenarios assuming disruptions in supply or demand, and the possibility that the new digester system will not operate at projected or peak efficiencies. Contractual protections are necessary to ensure the continuous delivery of the minimum required quantity of organic waste to the Facility until at least the financial break-even point is reached. The core function of the GLSD is to protect water quality and its member communities. The compounding of technical and financial assumptions must be closely examined in the totality to fully understand the sensitivity of the existing and future treatment processes to the proposed changes. The Town should closely track the concerns and issues raised in this Letter Report and require regular updates from the GLSD. Finally, a publicly financed project of this magnitude usually employs an independent Owner's Project Manager or peer reviewer to help protect the Owner and mitigate risks. See attached letter from Town Counsel dated March 29, 2010. The road has been flooded many times over the past few years where the culvert runs under the road. The beaver dam located downstream on property owned by Ben Farnum slows and backs up the stream above the elevation of the outlet of the culvert and over the road. Over the years the Town has worked with Mr. Farnum to breach the damn and trap beavers but it is a reoccurring issue. The road was repaired in 2010 after one such incident but because of the constant flooding since then the steel pipes and road bed have deteriorated beyond a simple repair. DPW believes that the road is unsafe for public travel,therefore,we have posted road closed signs and barricades. I have asked one of the roadway design consultants that we work with to review and give us an estimate for design,permitting, replacing the culvert, installing headwalls, and rebuilding the road at the culvert. Their estimate is $130,000. That is assuming the permitting is not too complicated. Although we have posted signs and barrels for the road closure I understand that people are still using the road. Jersey barriers could be placed to prevent this but we would need to coordinate with the property owner, Ben Farnum, since he uses the road for his farm operations. We have not received any further information from you, but we have done further research with the following results. It appears that the road now known as Brook Street in North Andover is a public way, having been accepted in.1850 by the Andover Town Meeting while the Town of North Andover was still a part of Andover. The minutes of the Andover Annual Town Meeting of March 4, 1850 include the following vote: I "Voted, that the road prayed for by Frederick Symonds and as laid out by the Selectmen be accepted provided the expense does not exceed three hundred dollars, The road as laid out by the Selectmen commences at a point a little north of the School House, bears North 63° E.95 rods and 17. links through land of Jacob Farnhum to the road leading from Jonas Symonds to Jacob Farnhum." The length of 95 rods and 17 links is approximately 1579 feet. This distance would appear to be consistent with certain plans showing Brook Street, including the following: 1. Plan Recorded with North Essex District Registry of Deeds as Plan No. 5000, dated January 2, 1964 of a Portion of Land of John C. In addition, records of two North Andover Town Meetings refer to Brook Street and authorize the Town to spend Town funds for repairs. The 1912 Annual Town Meeting voted, on petition of Benjamin H. Farnum and others, to appropriate funds to fix or repair Brook Street. The 1968 Annual Town Meeting voted to appropriate $50,000 to install and repair the existing j culverts on Johnson Street and Brook Street. The Town has also installed a water line in Brook Street. While we have not located a conveyance by deed or a taking by eminent domain of the fee interest in Brook Street subsequent to the 1850 Town Meeting acceptance, it was not uncommon at that time to lay out a public way without acquisition of the fee. Without a taking or a deed to the street, an easement is presumed upon the layout of a street by the Town: "When a public street or highway is laid out and constructed under the general I laws of the Commonwealth, the public acquires an easement in the land, which includes a right to.occupy it for every kind of travel and communication of persons and every movement of property, that is reasonable and proper in the use of a public street. [Citation omitted.] Subject to this paramount right, the owner of the fee retains his ownership of every valuable interest in the land, and he may use it in any way that does not interfere with the right of the public to the enjoyment of its easement:" Opinion of Justices,208 Mass. 603, 605 (1911). While the owner of the land upon which the street is laid out retains the fee interest in the property,the courts have held that the fee interest is subject to the easement of the Town: "By the location of a way over the land of any person, the public have acquired an easement,which the owner of the land cannot lawfully extinguish or unreasonably interrupt. But the soil and freehold remains in the owner although encumbered by a way." Perley v. Chandler, 6 Mass. 454, 455 (1810); Nylander v. Potter, 423 Mass. 158, 161 (1996). With regard to the installation of utilities,the Supreme Judicial Court has held that: "The easement for travel has been interpreted in a broad sense. It comprises the installation of water and gas pipes, sewers, telephone, telegraph, electric light and power poles, wires and conduits, fire alarm and police poxes, hitching posts, traffic lights, signs and similar devices, as well as the obvious methods of transportation and passage included in the general term. All of these are URBELIS &FIELDSTEEL,LLP March 29, 2010 Page 3 permitted because they facilitate the use of public ways for purpose of transportation or passage and promote the safety or comfort of those who travel. Whatever is done within the limits of the highway by the public or by members of it not justifiable as incidental to travel is a violation of the rights of the abutting owner." (citations omitted) Opinions of Justices,297 Mass. 559, 562 (1937). In light of this information, we are of the opinion that Brook Street is a public way, and the Town may do any work necessary to maintain the public way and the utilities installed within the public way, including water and..sewer lines. If you have any contrary authority which indicates that the Town may not repair the road and the culvert or install and maintain underground utilities,please let us know within the next two weeks. The premier training is the FBI-LEEDA program (FBI Law Enforcement Executive Development Association)as described below. Most supervisors have successfully attended the"trilogy"of courses and all supervisors will have completed this premier training within the next two months. Due to a grant we were able to have these courses tuition free. "FBI—LEEDA is a 501(c)(3)corporation. The majority of members of FBI-LEEDA are chief executive officers of law enforcement agencies,directors and commissioners of public safety,and elected sheriffs throughout the United States and numerous foreign countries. One of the requirements for active membership in FBI-LEEDA is to have participated in a Command Leadership Institute,the LEEDS training program at the FBI Academy,or one of the regional FBI Command Colleges located throughout the United States. Members of the association consist mostly of decision-makers from local,state and federal law enforcement agencies. In addition to FBI—LEEDA's mission to be the premier provider of leadership and management training,the association strives to provide information to its members which will enhance their ability to establish and maintain an outstanding quality of life in the communities in which they serve." The Police Department gave informational talks to members of the Senior Center and Rotary Club on how to identify and avoid contractor scams. Due to the extensive damage to homes caused by this past winter,we anticipate an increase in possible contractor scams.The talks highlighted certain factors to look for when hiring a contractor and how to protect oneself against subpar and incomplete workmanship. This information was also recorded for a monthly segment on NA Cam. As a result of two local bank robberies,NAPD Detectives organized and hosted a meeting with local police departments and the FBI Bank Robbery Task Force to compare information on recent bank robberies in NE Massachusetts. NAPD Detectives continue to work with these departments and the FBI to identify the suspect. i Our Police Officers Jason Wedge and Brian Faye seized 53 grams of heroin,with a street value over $5,000.00 and$2,300.00 in cash from a Saugus man when they responded to a shoplifting complaint at Kohl's Department Store. The defendant faces a minimum mandatory 5 year prison sentence for trafficking in heroin over 36 grams. The bike unit has been activated with the improving weather. They will be assigned the downtown area and Weir Hill. We received a grant from the Executive Office of Public Safety for distracted driving operators.
