Brown AC S DRAFT MINUTES Tuesday,May 3,2011 at 7:30 p.m. Senior Center 120R Main Street, North Andover, Massachusetts Members present: Ellen McIntyre, Richard Byers,Richard Vaillancourt, and Daniel Braese Associate Members: Thomas Ippolito and Michael Liporto Excused Absence Albert Manzi Also in attendance: Zoning Enforcement Officer, Gerald Brown Ellen McIntyre called the meeting to order at 7:30 McIntyre suggested a Pledge of Allegiance was in order especially after this week(with the events that took place with the Navy Seals). McIntyre stated that she wanted to take a Moment of Silence for"William J. Sullivan"who served as a member of the Board of Appeals from June 1977 to September 2004. Mr. Sullivan passed away a few months ago and he was very dedicated to the Town of North Andover and was also a great man. McIntyre said she was on the Board at the same time as Mr. Sullivan and it was always a pleasure to serve with him. McIntyre stated she wanted to take this moment of Silence to honor Mr. Sullivan. APPROVAL OF MINUTES April 12, 2011 Byers made a motion to approve minutes. Braese second the motion. Those voting in favor to approve the minutes were: Ellen McIntyre,Richard Byers, Richard Vaillancoutt, Daniel Braese and Michael Liporto 5-0 COMMITTEE REPORTS Housing Partnership Report,McIntyre talked of the Housing Partnership Meeting that she attended that was held in April. She stated that the Committee will have flyers available at the Town Meeting. These flyers will be in regards to the assistance down payment program and would also mention Stevens Corner, Greenery. McIntyre also informed the Board that Town meeting has been changed from May I Oth to June 7th. McIntyre stated the next item on the agenda is the Continued Public Hearing for Doug Ahern (JeffCo Inc),250 Sutton Street (Map 39 Parcel 19). He is asking for a Variance and a Special Permit. Brown SS CHUS McIntyre stated that Daniel Braese just signed a form stating that he missed the last hearing regarding this petition, but has reviewed all the evidence and he can now sit in and vote on this petition. With that being said Scalise walked over to the podium and announced his name and who he was representing. Scalise gave a brief history of the petition, stating this property involves a single family home in the IS Zoning District and that his client is proposing a 2 family home. Scalise also spoke of the reasons why it took so long to get to this point. Scalise stated that they will be moving the proposed house back and they have produced a new Mylar to reflect that change, also they have submitted a letter from the owner, and new landscape plans. Scalise stated by moving the house back it gives the property a bigger driveway. Scalise went on to say that the tree that was in question will be saved amongst other older trees on the lot. Scalise talked in detail of the lot, landscaping, driveway and also how the house will be set back on the lot. Scalise stated that the height of the house will be complied to, and the Building Inspector will see to that. Scalise told the Board that the house will be situated nicely on the lot, since they decided to move it back. Scalise felt that his client, Ahern has provided the Board with all that was requested of him. The board reviewed all the new plans in front of them regarding the property. Byers read aloud the letter from the owner dated April 18th 2011 that Doug Ahern provided to the Board. McIntyre asked if anyone was for or against this proposed plan. No one spoke up. McIntyre asked the Board if they had any questions. The Board was satisfied. Vaillancourt made a motion to GRANT a Special Permit to raze a single family home and to construct a new two family home in an I-S Zoning District. Vaillancourt referenced all the plans presented to the Board. Byers second the motion. All were in favor of this Special Permit; Ellen P. McIntyre, Richard J. Byers, Daniel S Braese, and Richard M. Vaillancourt and Michael Liporto. 5-0 Vaillancourt made a motion to GRANT the Variance to allow relief from paragraph 9.3-3 and Table I of the Zoning Bylaw within an IS Zoning District. The variance needed is for increase in structure. Vaillancourt referenced all the plans presented to the Board. Byers second the motion. All in favor of this Variance; Ellen P. McIntyre, Richard J.
