Town bylaws must be approved by the Attorney General's office while city ordinances require no such approval. Enclosed herewith is a copy of a letter dated August 20, 2001 from the Attorney General's office to the Town Clerk of Somerset. The letter discusses General Laws Chapter 143, § 98,which provides a mechanism for obtaining approval of regulations more restrictive than the State Building Code. With regard to bylaws,please note where the Attorney General states: As stated above, the State Building Code preempts local laws. Any provisions of local law that exceeds, competes, or conflicts- with the State Building Code or even deals with subject matter that has been preempted by the State Building Code will not have legal effect in the state. I return the amendments to the town by-laws adopted raider Article 33 of the warrant for the Somerset town meeting that convened on May 21,2001,with the disapproval of this.Office. [Disapproval#1 of 11. We disapprove and delete the amendments adopted under Article 33 because they are inconsistent with the State Building Code. Article 33 would amend the town's general by-laws by inserting a new provision pertaining to fire alarms. Specifically the new by-law would provide as follows: All buildings or structures required to install automatic suppressant or sprinkler systems in accordance with Massachusetts General Laws chapter 148, sections 260,26H, and 261, must install a master radio fire alarrn box,which shall be inspected and approved by the Somerset Fire Chief or his designee. Beginning with Chapter 802 of the Acts of 1972, as amended by Chapter 541 of the Acts of 1974,the Legislature eliminated local building codes intending thereby to create a state-wide "comprehensive" state building code applicable uniformly throughout all the communities of the Commonwealth. Today, any town seeking to enforce regulations more restrictive than those currently imposed under the State Building Code must request that the State Board of Regulations and Standards adopt such regulation G.L. c. 143, § 98. The Board will grant such a request only upon a finding, after conducting a public hearing, "that more restrictive standards 11/08/2001 12:19 FAX 14137841244 WESTERN MASS 011 are reasonably necessary because of special conditions prevailing within such city or town and that such standards conform with accepted national and local engineering and fire prevention practices, with public safety, and with the general purposes of a statewide building code id. As stated above, the State Building Code preempts local laws. The by-law adopted under Article 33 specifically requires the use of master boxes. The State Building Code, 780 C.M.R_ §§ 923.1 and 923.2, establishes fne requirements for the supervision of fire suppression.systems. The supervision requirements of the State Building Code allow a person to choose from any of 4 supervision options. By-laws that require that alarm supervision can only be by a master box system are inconsistent with the provisions of the State Building Code. Therefore, we disapprove and delete Article 33. Michael Rosati , Health Agent for the Town of North Andover. The letter concerns the status of the existing septic system for the above referenced property . Mr . Rosati outlines several items which he feels should be a addressed before a certificate of compliance is issued for the property . In response to the letter we make the following observations and recommendations : No. 1 . The contractor has indicated to us that the catch basin at the end of the driveway is not connected to any drainage system. The Contractor said he s r� would certify the same to the Board of Health and we recommend that you secure a letter from him to that affect. No. 2 . We feel that the fastest way to address the water table issue in the area of the septic tank and pump chamber is to assume that there is a buoyancy problem and anchor both tanks down in a manner acceptable to the Board of Health . Once the tanks are anchored down they can be pumped dry and inspected for infiltration . If groundwater is getting into the tanks , the contractor should make repairs in a manner acceptable to the Board of Health and consistent with current standards of construction in the industry . No. 3 . A series of shallow test pits above the force main will reveal the depth of fill above the pipe . If there is a deficiency it should be rectified to the Board of Health' s satisfaction . No. 4. The system installer should be able to identify the make and model of the pump and obtain a fact sheet from the manufacturer for the Board of Health' s review and approval . No. 5 . The manhole frame and cover should be installed as requested for ease of maintenance and inspection as specified in the letter . No. 6 . The installer should repair the damaged area of the leachfield to it' s original condition and to the satisfaction of the Board of Health . It is our opinion that these issues can be addressed by a qualified licensed installer and do not require any additional engineering +, effort. Please understand that our participation in this project relates only to those issues concerning the Board of Health at this time . Richard F. This plan was submitted to you once before and returned to us because of a question regarding a drainage easement. I met with Karen Nelson to discuss the need for the drainage easement change and would like to provide you with a brief summary of that discussion. The originally approved Campion Hall Definitive Subdivision Plan was lacking in many areas. Some of the shortcomings included: 1. Improper vertical curves on the street 2. Inadequate detention of storm water 3. Inadequate siltation control 4. Easements labeled as drainage and access easements that had to be used for sewer and water easements 5. No pump station design or easement shown. The North Andover Conservation Commission approved the project with only a cursery review but with several conditions in the order that required the owner to refile for a new Notice of Intent. I filed a Notice of Intent for my client the results of which was the construction of a sedimentation basin and a proposal to construct leaching trenches for peak flow control to be located on Lot 10. The easement to be changed as shown in the attached plan was an easement for these leaching trenches. Subsequently I filed a revision for drainage control which would substitute a 4,000 sq. ft. detention pond for the leaching trenches. That change was presented to and approved by the NACC. I did not receive an approval in writing and recently asked the NACC for its meeting notes for December 1986 to substantiate that this revision was in fact approved. The discussion which ensued related to the following matters: 1. The immediacy of the erosion problems which exist on the site, indetificaiton of the causes of the erosion, and discussion of possible mitigating measures. 2. The direct cause of the erosion is from the large amount of rain experienced in the recent past. The cause of the siltation has been identified as inadequate detention area design and deterioration of erosion control devices. 3. Three recommendations were made as mitigating measures: a. .Removal of all siltation from existing erosion control devices and replacement as deemed necessary by the NACC. b. .Removal of all siltation located downgradient of the erosion control barrier, with seeding and mulch- ing as per Soil Conservation Service Guidelines. c. .The water channel that has been formed in the rip- rapped area shall be altered by placing in the channel area stone of a size consistent with that existing, so as to disperse existing and future run-off from the detention pond. d. .The submittal of plans proposing a larger detention pond of 4000 square feet. (Refer letter dated: April 2, 1987 from Christiansen Engineering to Mr. Eric Nitzsche regarding Lots 10AA and 11A) . As our discussion related to your immediate response to these uests: 1. As you may recall, the approved plan for Campion Hall was lacking in several areas. Some of the problems with the plan were addressed by Planning Board in the Order of Conditions and were also addressed by Conservation Commission in its Order of Conditions. Additionally some of the problems in the roadway design were corrected by the developer in conjunction with the Highway Surveyor. The major omissions in the approved subdivision plan was the lack of proper drainage calculations for a 100 year storm, inadequate detention areas and limited siltation and sedimentation control. We addressed our resolution of these problems -through the Conservation Commission. (See attached Notice of Intent and subsequent modification) . Because this letter would be quite lengthy if we were to review all the past changes herein, I believe it would be better if we met before Mondays Planning Board meeting to review the full history of the changes. With respect to your letter of February 27, 1987 1 offer the following responses to your comments: 1 . The foundation for the house on Lot 10 AAA was constructed after I received approval from the NACC for the last redesign of the drainage system. 2. The Conservation Commission and the Highway Surveyor were informed of all of the changes to date. Planning Board has also signed revisions to these easements prior to the plan that is now before you. 3. Section 81W of the Subdivision Control Law allows modification of plans as you properly point out. The modification proposed is within the context of those regulations specifically paragraph 2. We are requesting this change to allow for the completion of the construction of the drainage works which is now in progress and for allowing the project to be constructed in conformance with plan prepared by this office and approved by the NACC and reviewed by the Highway Surveyor. This sub- division should not be approved until detailed plans and methods of this off site system is approved, by all parties, that should be satisfied for a proper long range solution, that will be in keeping with established policy and consistant with policies set by other town agencies. In my opinion, these concerns have neither been addressed or considered. I am also concerned with the methods and routes that will accommodate the sewers from lots between stations 13±00 and 18±00. I am not,in any way, trying to interfere with the Public Works Department or the requirements they set,for water and sewer installation, except when it interferes with, or is contrary to what,in my opinion, is in conflict with my department or other established policy, set by our community. Additional items: 1� 1. Road cross section and hottop depths are not acceptable. Proper cross section and details are available at the Highway Department Office. 2. All catch basins to have 4 foot sumps. 3. All brick to be clay brick layed in good quality cement mortar. 4. Two catch basins required at intersections of proposed roads and Great Pond Road. 5. As stated in my letter concerning the last set of "definitive plans" for Campion Hall, there is no statement of environmental impact as required in section 111 (5) . 2 . Although the connection of the water main on Bonney Lane is indicated on the plans as requested, there are too few hydrants and spacing of the hydrants shown does not meet regulation requirements section V (F) water facilities . �3 . I would expect as a matter of public safety and for access that both of the existing access roads from Great° Pond Road be used. Currently, one is blocked by a gate and fence . .)4. Also I would recommend that the road having lots 1-15 be considered a separate street from the road having lots 16-21 , and be indicated as such by // separate street names . 5 . Developers are advised to see the Fire Chief regard- ing the state open burning law. 6. Developers are advised that all underground fuel storage shall meet the requirements of the fire department for the watershed district . 7. Any plans for the razing of any structures on the site shall require the approval of the fire chief under chapter 148 section 28 .
