HomeMy WebLinkAboutPHASE II DECISION T THOMAS E:� ASSOCIATE INS. �G � r .°� January 28, 1986 �° E r Conservation Commission Town Hall North Andover, MA 01845 RE: Abbott Village Estates, Phase II, Connection of Nutmeg Lane to Salem Street Dear Commission Members: On Tuesday, January 21, 1985, I had the pleasure of meeting at a "Joint Session" held at the Town Hall Meeting Room for the purpose of reviewing Abbott Village Estates, Phases I and II . Present at the meeting were your Conservation Assist- and, Tracy Peter; your Town Planner, Karen Nelson; your Highway Surveyor, William Cyr, Planning Board Member, Erich Nitzsche; the developer, Benjamin Osgood, and myslef. The Town has voiced a concern that cooperative efforts, and simultaneous review, be done by all Town Departments, especially with larger subdivisions. Please find attached a copy of the "Decision" from the Planning Board issued on December 4, 1985. Please pay particular attention to the following items and accept my summation of what the intent of each item was to be Item #1. The Planning Board required that the Applicant file a Notice of Intent for work to be done on this project. Item #2. The Planning Board "flagged" certain lots which contain wetlands and wanted to notify "the record" that their decision on the subdivision did not construe the buildability of all lots. It was our intention to file under CH. 131 Sect. 40 for activities on all lots. Items #14, #15, #16. A small portion of new Woodbury Lane is located within the watershed of the Lake, and subject to the existing construction moratorium. A connection was required by the Planning Board. Item #19. In order to minimize the impact the traffic will create onto Abbott Street from Phase I and Phase II, the Planning Board has required that an additional point of access be provided. Sepcifically, the developer must construct Nutmeg Lane to Salem Street. The developer must clear obstructions on his own land to minimize the inadequate site distance of this new intersection. Please find attached a portion of a report prepared by Fay, Spofford, and Thorn- dike, Inc. , Traffic Engineers and Consultants, who were asked by the developer ENGINEERS 447 OLD BOSTON ROAD LAND SURVEYORS TOPSFIELD, MA n1983 LAND USE PLAN,,,iFRS (617) 887-8586 Conservation Commission January 28, 1986 -Page 2- to respond to the Planning Board's request for this intersection. Table No. 2 sepcifically shows that a proposed Nutmeg Lane, Salem Street interesection would not have the required site distance based on clearing brush and trees on property of the public or land of the developer. See Summary of findings. Although a requirement has been made to make the said intersection, this office does not recognize that this intersection is a reasonable means of access. Within the Notice of Intent of Phase II to you a position was taken that the intersection of Nutmeg Lane and Thistle Road was a limited project under Section 10.53, (3) ,(e) . This intersection is of minimum legal and practical width acceptable to the Planning Board. It has been designed in such a manner which does not restrict the flow of water. It does provide access from a public way to an upland area of the same owner where REASONABLE ALTERNATIVE MEANS of access is unavailable. A connection of Nutmeg Lane and Salem Street is NOT a reasonable alternative means of access. The design of such an intersection would be dangerous, and unacceptable since it does not have safe sufficient site distance. The Planning Board took a posture that circulation and the ability to reduce traffic flow into Abbott Street proved more sig- nificant than a sub-standard interesction. They want two points of access and egress from Phase II . Because of the preceeding explanation, supported by the engineering supplements provided by others and attached, this office is convinced that the Thistle Road, Nutmeg Lane intersection qualifies as a limited project. Planning Board Highway Surveyor -3-. / 10.53 : GENERAL PROVISIONS FOR PART III _ I1) If the issuing authority determines that a resource area is significant to an interest identified in the Act for - - which no presumption is stated in the Preamble to the ' - applicable section, --the --issuing authority - shall _ Impose such conditions as are necessary . to contribute to the protection of such interest. {2) ---When - the site --of - a proposed project -is subject to a Restriction Order which has been duly recorded under the provisions of G.L. c. 131, 540A, such a project shall conform to both the provisions contained in that Order and to these regulations. (3) Notwithstanding the provisions of Section 10.54 through 10.57 below, the issuing authority may issue an Order of Conditions and impose such conditions as will contribute to the interests identified in the Act permitting the following limited projects: (a) Work on land to be used primarily and directly in the raising of animals, including but not limited to dairy cattle, beef cattle, poultry, sheep, swine, �- horses, ponies, mules, goats, bees and fur-bearing animals or on land to be used in a related manner which is incidental thereto and represents a custom- ary and necessary use in raising such animals; and work on land to be used primarily and directly in the raising of fruits, vegetables, berries, nuts and other foods for human consumption, feed for animals, tobacco, flowers, sod, trees, nursery or greenhouse products, and ornamental plants and shrubs; or on land to be used in a related manner which is inciden- tal thereto and represents a customary and necessary use in raising such products, provided they are car- ried out in accordance with the following general conditions and any additional conditions deemed necessary by the issuing authority: 1. there - shall occur no change in the existing topography or the existing soil and surface water levels of the area; 60 -5- 10.53 : continued 2. 'the removal of trees shall occur only during those periods when the ground is sufficiently — _ frozen, dry or _otherwise _stable -to support the -- equipment used; and 3. all activities shall be undertaken in such a _ manner as to prevent , erosion and____s_iltation of - -- = adjacent water bodies and wetlands as specified by the O.S.D.A. Soil Conservation Service, "Guidelines for Soil and Water Conservation." 4. the placement of slash, branches and limbs ' resulting from the cutting and removal opera- tions shall not occur within 25 feet of the bank of a water body. (d) The construction, reconstruction, operation and main- tenance of underground and overhead public - utilities , such as electrical distribution or transmission lines, or communication, sewer, water and natural gas- lines, may be permitted, in accordance with the fol- lowing general conditions and any additional condi- tions deemed necessary by the issuing authority: 1. the issuing authority may require a reasonable alternative route with fewer adverse effects for a local distribution or connecting line not reviewed by the Energy Facilities Siting Council; 2. best available measures shall be used to mini- mize adverse effects during construction; . 3. the surface vegetation and contours of the area shall be substantially restored; and 4. all sewer lines shall be constructed to minimize inflow and leakage. '(e) The construction and maintenance of a new roadway or driveway of minimum legal and practical width accep- table to the planning board, where reasonable alter- native means of access from a public way to an upland area of the same owner is unavailable. In accordance with the Board of Public Works recommendations: Water main/hydrant requirements- A. Woodberry Lane - The water main on Woodberry Lane shall be installed 10 feet right of the centerline of the road. Eight inch Mueller or equal gate valves shall be installed at the existing water main on Woodberry Lane. - Eight inch Mueller or equal gate valves shall be installed at the existing water main on Abbott Street at station 8+10 and at the end of the existing water main on Woodberry Lane. Eddy breakflange 'hydrants to North Andover specifications are to be installed at sta. 0+20, 4+00, 8+00, 12+25 and 16+70. B. Thistle Road The water main on Thistle Road shall be intalled 10 feet right of the centerline of the road. Eight inch Mueller or equal gate valves shall be installed at the existing water main on Abbott Street and at sta . 4+70. - An eddy breakflange hydrant shall be installed at sta. 4+30 . C. Nutmeg Lane - The water main on Nutmeg Lane shall be installed .15 feet from the north property line and shall be extended along an easement on Lot 18 to connect with the existing water main on Salem Street . Eight inch Mueller or equal gate valves shall be installed at sta . 0+05, 0+15 , 3+80 and at the connection on Salem Street. - Hydrants shall be intalled at sta. 2+50 west, 5+80 west, and 4+90 east . D. Periwinkle Wad --The water main shall be installed 10 feet left of the centerline of the road. An eight inch gate valve shall be intstalled at sta. 0+0 . A hydrant shall be installed at the end of the cul de sac. E . A1.1 water mains shall be eight inch class 52 ductile iron cement lined water pipe installed with 5 feet. of cover below finish grade. 4 or equal gate valves (open left) . G. All gate valves shall comply with AWWA specifications L500 52T and will be supplied with a 100 lb. sliding, type gate box marked 'Water ' . . H . All water mains shall pass leakage and pressure tests pd -formed in accordance with section 13 of the AWWA standard C6910 and shall. be chlorinated in accordance with AWWA 0601 -- - 'Standard Procedure for Disinfecting Water Mains ' . Sewer requirements A. The proposed sewer on Abbott Street shall be i0 vitrified -- clay pipe installed approximately in the center of the existing roadway, and at a depth sufficient to provide service to existing dwellings on the south dide of the street. Five inch V.C. service connections to the property line shall be provided to"'all existing houses abutting the sewer . B .� The proposed sewer main on all the streets within the subdivision shall be 8" vitrified clay pipe installed in the centerline of the road. C. In order to eliminate unnecessary extreme of sewer on Abbott Street, Thistle Road and Nutmeg Lane, the sewer main shall be redesigned to flow esterly on Nutmeg Lane, from the cul de sac — to Periwinkle Way, southerly on Periwinkle Way, and then on 20 foot utility easements along the north side of Lot 13, the rear of lot 10 and the east side of Lot 9 to the proposed pumping station location. the sewer on Thistle Road may be eliminated and the grades changed on Abbott Street. ' D. The sewer main on Woodberry Lane shall be extended from station 17+50, a distance of approximately 325 feet to the --- - - centerline of the existing portion of Woodberry Lane. E . The grade of the sewer on Woodberry Lane shall be changed to a more reasonable depth from station 13+75 to 17+50 unless justification is provided for leaving the sewer `at the proposed grades . 1 F . Plan and profile shall be provided for the sewer on Abbott Street, the extension on Woodberry Lane, all cross-country sewer, and all redesigned sewer. G. A plan showing the proposed design of sewer and water services shall be provided for lots 36 , 37 ,43, 51•, 53; and 57 . 11. Precast manholes shall conform to ASTM designation C478 and shalt meet the following additional requirements: -' the wall thickness shall be not less than 5 inches, section shall have tongue and groove jointas with an approved bitumastic gasket, - pipe connections shall be of the rubber boot with stainless steel band or approved equal , manhole frames and covers shall be cast iron :lettered ' Sewer ' and shall be eight inches high. 12 . All sewers must pass low pressure air tests with a maximum allowable leakage rate of 0 .0015 cubic feet per minute per minute, per square foot of internal pipe surface. 13 . Adequate public liability and property damage insurance as well as a street opening bond in an amount satisfactory to the mir,liwav q„rvPVr,r must be .provided for the work on Abbott Street . 4. 14 , In accordance with the Board ' s decision on Marbleridge 'Estates (W66dWry LaW ©afinitive Plan dated 1/13/76, rev14/15/76i rind Approval dated 3/18/76, specifically condition no. 7 "Th6t the proposed 50 foot roadway easement from the turn-around be aligned along the lot line between lots 6 & 7 ." ; a connection shall be made as shown on the Abbott Village Plan dated 5/31/85,. Associated utilities such- as those recommended by -the board of Public Works shall be connected to the existing Woodberry Lane. 15 . The connection requiremenC is in full compliance with the - ---Board ' s Mules, Section SI,B,5 "Streets shall _be _la_id out as to provide for continuation of the principle streets adjoining or entering the subdivision. . .so as to provide an adequate and convenient system for present and potential traffic needs. . . " . 16 . That portion of the Woodberry Lane connection :that lies within the Watershed District shall not be constructed unless the Watershed Moratorium, Section 4 .133 (4 ) Lake Cochichewick Preservation Amendment has been removed in accordance with M.G.L. Chapter 40A and the North Andover Zoning Bylaw. During the moratorium, Lots 46 and 47 shall have a constructed .temporary turn around which will be removed at, a time in which connection is made to existing Woodberry Land per Section IV,A,1, e. - Security in an amount to be established by the Board shall be held for the connection through to Woodberry Lynne. At the time the moratorium is lifted the Board will instruct the developer as to the feasibility of connecting the ,two cal de sacs. 17 . The developer shall include a clause in the purchase and sale agreement of Lots 46 and 47 that reflects that the temporary turn around will be removed for connection with Woodberry Lane. All other lots on Woodberry Lane shall include a notation in the deed that the road will .be continued. To be noted on the record plan , 18 . The Board will not grant the applicant a wa�v, bf strict compliance under M.G.L. Ch.40A, Section 81-R and Section I37,A,4,a and II ,B,S,a concerning the length of Dead End Streets in the Rules, specifically NUTMEG LANE SOUTH TOWARD SALEM STREET. 19. In~order to minimize the impact the traffic impact on Abbot Street and to improve circulation the Board will require an additional point of access as noted in the Traffic Memorandum prepared by the Board ' s consultant . A Salem Street/Nutmeg Lane point of access through Lot 18 -shall be designed with associated intersection improvements to provide sufficient sight distance and roadway widening to allow a northbound vehicle to safely move around a vehicle stopped to make a left turn onto Nutmeg. This is in accordance with the purpose Subdivision Control Law regarding the regulation of the layout and construction o fways in the subdivision providing convenient access to lots therein, and for lessening the congestion in such subdivision and adjacent ways .. - Such intersection improvements shall be shown on separate "i a.,c f, ?-,o rPV ; pwaA Ana annroved by the Board . 5. ' - -- -- Improvements shall be made within the Salem Street right of way and land owned by the developer. 20 . The Board shall require a 50 foot access ;easement. deeded to North Andover for. the -intention of future acceas .t� N/F Earnshaw on Lots 27 , 57 and 58 . The purpose of this requirement is to uphold Board -policy of Section II ,B, 5 of the ,.Riles and ' Regulations. , --To be changed on defintive plans prior to p4gning and recording. { -21 . The conditional approval. of Said plan shall not infer approval of any requests for Common Driveways-under 'Sect ion 2.30. 1 of the ,# Zoning Bylaw. 22. All drainage detention areas shall be noted on plans as drainage ea•seme4'tS S . .f! 23 . At Lots and 23, a cross section and detail shall be shown Attailing headwalls for approval prior to signing plans . Due to the close .proximity of detention ponds on said lots, side -slopes of 2: 1 shall be required from edge of R-O-W with guardrails at the top of the slope along areas of fill to ensure the safety of the public. Driveway access to Lot 10 shall show detail of side •sloping which shall be at a 2:1 slope. 24. Proper side slopes of 2: 1 shall be provided from the sideline of the R-O-W to the bottom of the detention areas on lots 42, 44, 49 with guard rails-at top of side slopes along fill areas to ensure the safety of the public. This will. cause the detention ponds to be moved to the North. , 25 . Side slopes of the roadway crossing along Lot 35, 36, 37, and 38 shall be constructed to 2: 1 from sideline for R-O-W with guardrails for safety purposes. 26 . Security in the amount of $13,800.00 shall be posted with the Town to ensure satisfactory submittal of final as-built and acceptance plans to be recorded at the Registry of Deeds after review by the Board. 27 . The applicant/owner/developer shall be aware of the fact that approval of this subdivision under the Board 's Rules will not relieve said parties of the responsibility to other property owners upon whose land may be affected by indirect or direct development storm water discharge. 28 . Roadway cross section shall be revised to conform to Rules and V Regulations. 29 . The sewer and pump station. details to be approved by Public Works' -.and shall be submitted to the Board to ascertain compli4nce with these plans prior to any construction. 30 . The developer shall present to the Board prior to`' any construction commencing, satisfactory evidence of intentions to control construction traffic and earth removal activities.- These methods shall include, but not be limited to hourly limitation of heavy truck traffic and breaking development into 6. phases to minimize the amount of unstabilized excavated land area . • The developer shall take every precaition to minimize the removal of mature trees within the subdivision in order to reduce drainage resulting from all construction. - - - _ 31 . SPOFFORD b THORNDIKE. INC. LEXINGTON. MA SUMMARY OF FINDINGS The following sections of this report present the existing and projected traffic levels for the Abbott Street study area. Based on these traffic levels and existing physical characteristics of the area's roadway network, a detailed analysis of present and future operating conditions was performed. The following major points are drawn from this : analysis and other work completed during this study. y o A total of 71 single-family homes are proposed for the Abbott Street area. These are divided as follows : Abbott Village Estates: 58 .Units (by Osgood Associates ) - Francis Estates: 8 Units (by others) - Florence Estates: 5 Units (by others) o A total of approximately 852 daily vehicle trips will be produced by these 71 single-family units, or 426 inbound and 426 outbound trips over the course of an average day. o The existing level of service (LOS) during peak hours on area roadways and intersections is LOS A. This LOS is attributable to the low traffic volumes in relation to roadway capacity (V/C 0. 08 to 0. 17 ) of this area' s streets, and is the highest and best category of LOS, which is a concept used to describe the acceptability of traffic operating conditions. o Following full occupancy of the 71 proposed residential units (and in light of increased Willow Street area office park traffic in this residential area) , LOS A will remain in effect during peak periods on those area roadways and intersections analyzed in this study. Even though daily traffic increases will be 40 percent to 100 percent, resultant traffic volumes will still be only a small fraction of available roadway capacity. o Roadway improvements will not be required to accommodate traffic generated by Abbott Village Estates, nor are roadway improvements required to accommodate Abbott Village Estates traffic combined when Francis and Florence Estates traffic. However, in the future should any road work or sewer/water work be conducted on the narrow eastern section of Abbott Street between Easy Street and Salem Street, FST does recommend widening this section of Abbott Street to 20 feet. This is because the existing width of 16 feet, while adequate capacity wise, is not a desirable width for safety reasons. o Acceptable sight distance exists, or with selective _ clearing of brush within existing roadway right-of-way or on the developer' s property can exist, at all Abbott -3- j Village Estates ' proposed intersections with Abbott Street. Acceptable sight distance exists at the intersection of Woodberry Lane and Marbleridge Road. o -Adequate sight distance does not exist at the proposed - intersection of Nutmeg Lane and Salem Street. _ Adequate sight distance can not be achieved through clearing on _ lands in the public right of way and/or lands owned by the project inability -to- achieve -- > - - p � proponent. � $ecause of this -acceptable sight distance, FST does not recommend the - proposed connection between Nutmeg Lane and Salem Street. o There 'Is no `change in level of service on area roadways or at area intersections resulting from a connection between existing Woodberry Lane and the proposed Woodberry Lane - Extension. There is no significant traffic operations - benefit from this proposed Woodberry Lane connection to Abbott Street. 1 r. -4- SIGHT DISTANCE In response to concerns raised by area residents and the North Andover Planning Board FST established existing sight distances at the following intersections (Figure 2 ) : 1. Existing intersection of Woodberry Lane and Marbleridge Road. 2 . Proposed intersection-of _Thistle -Road and Abbott Street.-- 1--_ 3 . Proposed intersection of Woodberry Lane Extension and Abbott Street. 4 . Proposed intersection of Nutmeg Lane and Salem Street. Sight distance in these cases is the clear view recommended for turning movements from intersections. The distance required is a function of several factors, prime among which is miles per hour (mph) or vehicle speed. For the purposes of this study a speed of 45 mph was applied to Salem Street while 35 mph was used in the analysis of proposed intersections with Abbott Street and Marbleridge Road. Table 2 presents the findings of this analysis. As indicated by Table 2, the existing Woodberry Lane and .� Marbleridge Road intersection does provide adequate minimum safe stopping sight distance. While acceptable minimum sight distance does exist in one direction at each of the proposed intersections with Abbott Street, minimum sight distance does not exist in both directions at both 'locations. However, minimum acceptable sight distance can be obtained and exceeded in these locations through clearing of brush and trees which currently obstruct vision. Regarding this clearing in the case of the two proposed Abbott Street intersections, all necessary clearing can occur on lands within the roadway right-of-way and/or lands owned by the project proponent. Once these lands are cleared, FST recommends that this cleared condition be assured over time either through deed restrictions, or some other instrument which will have legal power to assure that these cleared sight lines are not compromised in the future by plantings, fences or other obstructions. Finally, regarding the proposed intersection of Nutmeg Lane and Salem Street, as indicated in Table 2, minimum safe stopping sight distance does not exist to the left nor can it be obtained by clearing solely upon lands within the roadway right-of-way and/or lands owned by the project proponent. Under this condition, FST does not recommend creating an intersection at Nutmeg Lane and Salem Street.
