HomeMy WebLinkAbout1986-02-27SPECIAL MEETING February 27, 1986 The PLANNING BOARD held a special meeting on Thursday evening, February 27, 1986 in the Town Office Meeting Room. The following members were present and voting at the meeting: Michael P. Roberts, Chairman; Paul A. Hedstrom, Vice-Chairman; Erich W. Nitzsche and John J. Burke. DECISIONS Foresta - Village Way - Special Permits Motion: By John J. Burke to approve the Special Permit submitted by Anthony Foresta for Road construction and Lot #5 house construction in accordance with the conditions stated in the approval. Second: Erich W. Nitzsche. Vote: Unanimous. Coventry - Spcial Permit Motion: By John J. Burke to approve the Special Permit for dike construction submitted by Coventry development Corp. in accordance with the conditions stated in the approval. Second: Erich W. Nitzsche. Vote: Unanimous. Note: These Special Permit conditions hereby becomes a part of these minutes. BOND RELEASE Bridges Lane - John J. Burke abstained from voting. Motion: By Paul A. Hedstrom to release $37,000 in accordance with the Highway Surveyor's recommendation. Second: By Erich W. Nitzsche. Vote: Three in favor; one abstention (J. Burke.) PUBLIC HEARINGS Increase in Fine For Zoning Bylaw Violation The purpose of this amendment is to increase the present zoning violation fee of $20 per zoning violation each day to $300. Motion: Second: Vote: By Erich W. Nitzsche that the Planning Board give a favor recommendation to this article for Town Meeting. John J. Burke. Unanimous. Minimum Contiguous Buildable Lot Area Requirement John J. Burke read the legal notice for this article. This article states that any new lot will be required to have at least 75% of the lot area as non-wetlands as described in the Wetlands Protection Act. For example a lot in a Residence 2 District (1 acre minimum) must have a minimum contiguous area totaling 32,670 square feet of land without wetlands to qualify as a buildable lot. The dwelling must be located in that contiguous buildable area (CBA). February 27, 1986 - Continued Those in favor who spoke for the article were John Simons of the Zoning Bylaw Committee, Gayton Osgood, Board of Health, Jack Linden and Jim Lafond of the Conservation Commission. Joseph Averka, Rea Streeet did not support this article. Motion: Second: Vote: By Erich W. Nitzsche that the Planning Board give a favorable recommendation to this article for Town Meeting. Paul A. Hedstrom. Unanimous. For Profit Educational Facilities by Special Permit At present the bylaw does not differentiate between public/ private non-profit educational facilities and for-profit educational facilities (other than for Day Care.) This amendment requires a Special Permit review process in order to allow a for-profit educa- tional facility to locate in a Residence 1,2,3,4,5 District (Special Permit meaning public hearing and abutter notification.) Motion: By Erich W. Nitzsche that the Planning Board give a favorable recommendatiOn to this article for Town Meeting. Second: John J. Burke. Vote: Unanimous. Municipal Uses by Special Permit. Table 1 - Summary of Use Regulations permits municipal uses by Special Permit in Residenc~,~5~stricts, however, the word use was not placed within the detailed district use regulations S-~-~tion 4.122 of the Bylaw. Motion: Second: Vote: By John J. Burke that the Planning Board give a favorable recommendation to this article for Town Meeting. Erich W. Nitzsche. Unanimous. Increase Open Space Requirement Abutting Residential Area~ The purpose of this article is to increase the industrial buffer zones when industrial districts and business districts abut residential districts. Charles Foster, Building Inspector, spoke against this article because many property owners who have non-conforming industrial lots will not be able to develop them because of this article. Motion: Second: Vote: By John J. Burke to take the matter under advisement, Paul A. Hedstrom. Unanimous. Minimum Front Setback of Open Space from Street in Non-Residential Districts This article requires all non-residential front setbacks to have a 10 foot setback consisting of a vegetated green area from the street.
